1. SERVICE CONTENT AND TERMS OF USE

Reactored, maintained by Rouhia Oy (hereinafter “Service Provider”), is a learning environment that functions as a cloud service and is used with an Internet browser. The service is primarily intended for use by educational institutions as well as individual students and teachers, but the service can also be used by associations and companies. These Terms of Use apply to your use of the Service described above (hereinafter the “Service”). The Terms of Use govern the relationship established between the Service Provider and the Service Users (hereinafter also the “User”). The rights of the Service are owned by the Service Provider and the User is granted access to the Service in accordance with these terms of use. By registering for and / or using the Service, the User accepts these terms and agrees to abide by them. If the User does not accept these terms, he cannot use the Service. Furthermore, when using the Service, the User must comply with the legislation in force at the time, other applicable regulations and good manners. These terms and conditions have been accepted by the natural person or legal entity.

2. PRIVACY

When processing personal data, the service provider complies with the provisions required by the Data Protection Regulation and the applicable legislation. More detailed information on the processing of personal data can be found in the privacy policy, which each User registering on the Service must read before registering. Registering as a user of the Service means that you have read and accepted these terms.

3. REGISTRATION AND USER ID

The Reactored language learning platform Service is intended for users of all ages. Each User of the Service may have only one user account. When registering for the Service, the User must provide the identification information required in the registration form. In order to use the Service, the User will receive a password (8 characters) and/or a user ID, which will allow the User to log in to the Service. The username associated with the user account must not contain offensive or criminal incitement and must otherwise be in accordance with good manners.

A person who has reached the age of 13 can create a username and register as a User himself. For users under the age of 13, use of the Service requires the consent of a guardian, parent OR educational institution. By logging in to the service, the User assumes the responsibility that consent has been given. The legal guardian of a minor may deny the right to use the Service, in such situations the introduction of Reactored is impossible even if the use takes place under the supervision of a teacher. If you wish to be denied access, a parent must submit a request for a ban in writing to support@reactored.com

By using the Service and registering for the Service, the User must provide all the information required from the User truthfully and correctly. The Service Provider may exercise its right under Section (10) of these Terms of Use to lock or delete the User’s user account if the User has attempted to mislead the Service Provider.

Users are responsible for the actions performed with their own user account. The username and password are personal and may not be passed on to third parties. If the password or username becomes known to third parties, the User must immediately notify the Service Provider.

4. DATA STORAGE AND BACKUP

4.1 Processing of personal data
The service provider acts as a data controller within the meaning of the Personal Data Act. To the extent required to use the Service, the Service Provider may collect and process the User’s personal data (e.g. the User’s contact information, payment information and identification data). You understand that by using the Service, you consent to the collection and use of such information, including the transfer of such information to other countries for the purpose of storing, processing and using the information. More information on the processing of personal data can be found in the privacy policy.

4.2 Material storage
The Service User may store material on the Service Provider’s server. However, the Service Provider does not guarantee the preservation of the stored data and is not liable for any damage that may result from the alteration, loss, destruction or deletion of the data. In order to preserve the data, the Service User is obliged to take care of backing up the data and materials stored on the Service Provider’s server.

5. FEES AND TERMS OF PAYMENT

In return for using the Service, the User pays the compensation specified by the Service Provider for the Service. Compensation for the Service will be charged in advance before the start of the subscription period for the Service. Payment must be made using a payment method approved by the Service Provider. 

If the User terminates the subscription period for the Service prematurely, the User is not entitled to a refund of the payments already paid. If the use of the Service is blocked due to a reason caused by the Service Provider, the unused part of the Service will be reimbursed to the User by extending the usage time of the ordered Service.

The Service Provider has the right to change the prices charged for the Service at any time with 30 days prior notice. Payments for existing subscription periods will not be affected by any price changes.

Orders are automatically renewed at the end of the billing period.
Note! Set a reminder for the expiration period if you plan to use our Services only once. Automatic billing occurs in advance at the beginning of each billing period.

Private users: You can cancel your subscription at any time in the licenses section of Reactored settings. Cancellations can also be made by email to: info@reactored.com.

Companies, associations and organizations: If you wish to cancel your order, you must notify us 30 days before the end of the current order period.

6. RESPONSIBILITY FOR USE OF THE SERVICE AND USER CONTENT

The User of the Service is responsible for all material that he / she stores on the Service and / or makes available to others using the Service (e.g. by uploading the material to the Service, using various linking methods and in other possible ways). The Service Provider does not actively inspect the material produced or delivered to the Service by users and therefore does not take responsibility for the content of the material.

6.1 Prohibited Content and Activities and User Liability

The Service may not transmit or store material on the Service Provider’s server:

which infringes the copyright or other rights of third parties (so-called third parties)
which infringes, denigrates, harasses or threatens someone
which impairs the functioning of the service
which is otherwise contrary to a right or good practice in force in Finland.

As a user and distributor of the material, the User is fully responsible for the content he creates. Regardless of whether the content is text, graphics, audio files or any other format in which the Service provides the ability to store data.

The purpose of the service is to serve as a platform for language learning, and we hope that users will only share learning material. Below are examples of content and activity that is prohibited or illegal to make, download or distribute through the Service.

  • Is apparently offensive and promotes racism, hatred, or physical harm from any class or individual.
  • Harasses or defends another person from harassment in any form.
  • Exploit people in a sexual or violent manner.
  • Contains sexually suggestive, overly violent, or offensive topics.
    request personal information from anyone under the age of 18.
  • Publishes information that poses or may pose a security risk to anyone.
  • Contains information about another person that has been posted without that person’s consent.
  • Infringes privacy, publicity, copyright, trademark, contract or other rights
    contains or promotes an illegal or unauthorized copy of another person’s copyrighted work.
  • Encouraging or promoting criminal activity or attempting or providing information on illegal activities, including, but not limited to, making or acquiring illegal weapons, violating data protection, or providing or creating computer viruses.
  • Edit or attempt to emulate another user, person, or community.
  • Use another user’s user account or username or password at any time, or provide a password to a third party or allow a third party to access your account.

Any user of the Service who notices material added to the Service that violates these Terms of Use or notices that the Service has otherwise been used in violation of these Terms of Use must immediately notify the Service Provider.

The Service Provider reserves the right to investigate and take appropriate legal action against any user who, in the Service Provider’s sole discretion, violates this provision, including without limitation, to report such action to law enforcement authorities.

It should be noted that the Service may contain material that is offensive, inappropriate or otherwise questionable, as well as content that may contain technical inaccuracies, typographical errors and other errors. The Service may also contain material that infringes or violates the intellectual property and other proprietary rights of third parties, or the downloading, copying or use of which may be subject to other obligations or conditions.

7. RIGHTS TO USER-GENERATED CONTENT

These terms of use do not affect the ownership of the material provided by the User to the Service, but the rights remain with their legal holders. Pursuant to these Terms of Use, the Service Provider does not acquire any rights to the above-mentioned material other than what the Service Provider needs to implement the Service in accordance with the Terms of Use.

Furthermore, the Service Provider may exercise its rights mentioned in Section 10 (“Consequences of Violation of the Terms of Use”) (e.g., to remove material that violates the Terms of Use from the Service).

8. SERVICE MAINTENANCE, UPDATES AND CHANGES TO THE TERMS OF USE

The Service is constantly being developed, and changes may also affect the Terms of Use. The Service Provider has the right to unilaterally change these Terms of Use at any time. Changes to the Terms of Use will be announced separately in a manner deemed appropriate. By using the Service, the user of the Service accepts the changed Terms of Use after being informed of the changed Terms of Use.

The Service Provider strives to provide the best possible operational reliability, and the Service is basically available 24 hours a day. However, the Service Provider does not warrant the operation or features of the Service.

The Service Provider reserves the right to make changes. The Service User understands and accepts that the development, modification and termination of the Service, in whole or in part, is at the sole discretion of the Service Provider. The Service Provider may also from time to time change its practices for providing commercial content or displaying advertising, and may do so without notice.

9. SERVICE INTERRUPTIONS

The Service Provider shall not be liable for damages resulting from technical failures, maintenance work, upgrades, interruptions in the telecommunications network, Internet network or other possible circumstances. We are constantly developing the Service to better meet the needs of our users, and changes can also affect the Terms of Use.

10. CONSEQUENCES OF VIOLATION OF THE TERMS OF USE

The Service Provider has the right to remove the material in the Service or block the material distributed using the Service, which in the opinion of the Service Provider violates the rules and principles mentioned in these Terms of Use.

In addition, the Service Provider has the right to lock or delete the Service User’s user account if the User violates its obligations arising from these Terms of Use (for example, by adding material to the Service that violates the Terms of Use, using the Service against good manners or otherwise).

Upon receiving information about the violation, the Service Provider may lock the user account / ID immediately. In this case, the Service User who has committed the violation will no longer be able to log in to his or her user account and the materials uploaded by the user will not be visible to other users. When the user tries to log in to his / her account, he / she will be notified that the account is locked and the contact details of the Service Provider will be provided in order to find out the consequences of the violation. If the User does not contact the Service Provider within 60 days, the user account may be deleted completely.

11. LOCKING / DELETING A USER ACCOUNT ON THE BASIS OF INFRINGEMENT NOT RELATED TO THE TERMS OF USE

In addition to the information mentioned in Section 10, the Service Provider has the right to lock the user account / ID if the following conditions are met:

The user has not logged in to his user account / used his ID for 6 months. The Service Provider notifies the User of this fact to the e-mail address provided by the User to the contact details of the Service. The User is prompted to reactivate the account. If the User does not activate his account within 60 days of sending the notification, the user account / ID may be deleted from the system completely.

12. TRANSFER OF RIGHTS

The Service Provider has the right to transfer all or part of its rights or obligations to its subsidiary or potential successor or purchaser of business assets. You may not transfer any or all of your rights or obligations under this Agreement.

13. APPLICABLE LAW AND DISPUTE RESOLUTION

Finnish law applies to these terms. Disputes arising from the terms will be resolved primarily through negotiations. If a settlement cannot be reached through negotiations, the dispute will be resolved in the Kanta-Häme District Court.
